Obtained the imposition of interim measures for the personal property of the debtor's spouse

In the bankruptcy case of a citizen who was our client's debtor, we filed a petition to seize the property of the debtor and his spouse.

Some time before the bankruptcy the debtor had entered into a prenuptial agreement under which the spouses became the owners of shares in the authorized capital of a number of organizations. The market value of the shares was about 90 million rubles. The court of first instance refused to seize these shares, arguing that the seizure of the wife's personal property was unreasonable and would violate her corporate rights.

However, the appeal agreed with us that the lack of arrest would make it possible to sell the shares, which would violate the rights of the creditors. The provisional measures were imposed.
